Shipping and delivery
In-stock products are handed to Brink’s Kargo within no more than 2 (two) business days after order confirmation. Products not in stock for which an order is accepted are handed to Brink’s Kargo within no more than 14 (fourteen) business days. The SELLER pays shipping within Türkiye; the BUYER pays TRY 0. The order-specific delivery timeframe is shown in the order summary before payment. Delivery does not normally exceed 30 (thirty) days from the order date; for goods prepared to the BUYER’s requests or personal needs, the separately stated order timeframe applies. Dispatch to the carrier is not delivery to the BUYER. Orders are shipped only to addresses in Türkiye.
This notice explains the scope and exercise of the right of withdrawal for purchases made through https://annalisadiamond.com (the “Website”), operated by ÖZKAN KIYMETLİ MADENLER VE KUYUMCULUK ANONİM ŞİRKETİ (the “SELLER”). It forms an integral part of the Distance Sales Agreement.
1. RIGHT OF WITHDRAWAL AND PERIOD
1.1 The BUYER may withdraw from a contract for a product purchased through the Website within 14 (fourteen) days after receiving the product, without giving a reason or paying a penalty.
1.2 The period begins on the day the product is delivered to the BUYER or a person designated by the BUYER. Handing it to a carrier is not delivery to the BUYER. If products in one order are delivered separately, the period begins on delivery of the last product.
1.3 The BUYER may also exercise withdrawal between placing the order and delivery.
2. WITHDRAWAL NOTICE
2.1 It is sufficient to send the withdrawal notice to the SELLER before the 14-day period ends. The notice may be sent to [email protected] or by post to Levent Mah. Begonya Sk. No: 2, Interior Door No: 1, Beşiktaş / Istanbul, Türkiye.
2.2 The order number is sufficient in the notice. The BUYER may use the Withdrawal Form attached to the Distance Sales Agreement or any other clear statement of the decision to withdraw.
2.3 Receipt of an email withdrawal notice is confirmed to the BUYER without delay. Customer service telephone: +90 212 812 92 45.
3. RETURNING THE PRODUCT
3.1 The BUYER sends the product to Levent Mah. Begonya Sk. No: 2, Interior Door No: 1, Beşiktaş / Istanbul, Türkiye within 14 (fourteen) days after sending the withdrawal notice.
3.2 For statutory withdrawal from an eligible product, the SELLER pays return shipping; the charge is not imposed on the BUYER. The BUYER contacts the SELLER at [email protected] for return-shipping details. Requesting those details is not a prerequisite for the withdrawal notice or the 14-day return period.
3.3 The SELLER sends the return-shipping details to the BUYER by email. The withdrawal period and obligation to return the product do not wait for those details.
3.4 The product should be sent with its invoice, certificate, warranty document, box and any gift or promotional item supplied with the order. A return invoice must be included if the original invoice was issued to a legal entity. The box, certificate and warranty document are part of the product and delivery; the SELLER reserves the right to claim their value if they are returned missing or damaged.
3.5 The BUYER is not liable for changes or deterioration resulting from use consistent with the product’s operation, technical features and instructions during the withdrawal period. The BUYER is liable for loss in value caused by use contrary to the product’s purpose, deformation, resizing or alteration.
4. REFUND
4.1 The product price and any delivery charge are refunded within 14 (fourteen) days from the date the product is handed to the shipping company for return. If withdrawal occurs before delivery, this period begins when the notice reaches the SELLER.
4.2 The refund is made in a single payment through the original payment instrument without cost to the BUYER. The time for a card refund to appear in the account depends on the bank. Bank-transfer/EFT payments are refunded to an account in the BUYER’s name.
4.3 If withdrawal causes the order value to fall below a promotion threshold, the gift supplied under that promotion must also be returned; otherwise its Website sale price is deducted from the refund.
5. PRODUCTS OUTSIDE THE RIGHT OF WITHDRAWAL
Under Article 15 of the Distance Contracts Regulation, the following products are outside the right of withdrawal. This status is separately shown on the product page and before order confirmation.
a) Products whose prices depend on financial-market fluctuations: gram and bullion gold, silver and platinum, and quarter, half, full, Ata, Reşat and similar bullion or minted jewellery products.
b) Products prepared to the BUYER’s requests or personal needs: items engraved inside or outside with a name, letter, date, writing or symbol (including engraved wedding bands); products made at the BUYER’s request outside the size, length, metal-colour and stone options offered on the Website; and products resized, changed in length or remodelled at the BUYER’s request after delivery.
c) Earrings, piercings and similar products unsuitable for return for health or hygiene reasons where their protective packaging or security seal has been opened after delivery.
6. RINGS MADE TO ORDER
6.1 Rings described on the Website as “made to order” are not kept in stock; they are made to the finger size stated by the BUYER when ordering. They constitute goods prepared to personal needs under Article 15(1)(b) of the Regulation and are not eligible for withdrawal, return or exchange.
6.2 Withdrawal may be exercised for rings shipped from stock in their existing size.
7. IN-STORE PURCHASES
Physical-store sales have not yet begun.
8. DEFECTIVE GOODS
Nothing in this notice limits the BUYER’s alternative remedies for defective goods under Article 11 of the Consumer Protection Law No. 6502. The SELLER pays all costs of returning defective goods.
